Randy Foret joined Fowler Rodriguez in August 2014, as a partner in the Houston office. Mr. Foret has practiced law in Texas for 22 years and he has a history of delivering cost-effective legal and innovative business solutions for startup businesses and clients in the energy (oil & gas), alternative energy, construction, automotive and financial services industries.

He also has extensive trial experience in oil & gas related litigation (royalty, title disputes and operator related disputes), securities-related litigation (class action, FINRA, SOX and SEC enforcement), IP litigation (patent, trademark, copyright and trade secrets), employment litigation (Title VII, ADA, ADEA, FLSA, FMLA and non-competition) and construction litigation (home defect disputes and construction liens). In addition, Mr. Foret has successfully arbitrated cases in a variety of forums including the AAA, ICDR and NASD / FINRA arbitration forums.

In addition to handling commercial litigation matters, Mr. Foret has represented clients in a variety of regulatory matters, including SEC enforcement matters, state securities agency investigations, DOJ, DOL, OSHA and EPA investigations. Mr. Foret also acted as counsel for the receiver in several SEC receiverships tasked with recovering assets for defrauded investors.

Prior to joining Fowler Rodriguez, Mr. Foret founded and operated his own law firm and served as a founding member and the outside general counsel of an oilfield service company startup that developed patented plasma-related technology designed to treat oilfield liquid and solid waste. As outside general counsel, Mr. Foret assisted the company in obtaining grants and drafted the full range of operational documents required by the startup. He also designed the contract templates utilized by the startup.

Prior to attending law school, Mr. Foret attended and graduated from an API certified drilling fluids training program in 1981 in Houston, Texas. After obtaining the certification, Mr. Foret worked as a drilling fluids (“mud”) engineer in the Santa Barbara Channel in California and the Gulf of Mexico on a variety of offshore drilling operations (including jack-ups, drill ships, semi-submersibles and platforms). During his 5 year career as a mud engineer, Mr. Foret maintained a number of API certifications, including surface and sub-sea well control certifications.

  • Vern Siemens vs. Mullins & White Exploration, Inc. (ICDR # 50 180 T 00526 08): Client awarded $1.6 million by ICDR arbitration panel in oil & gas fraud dispute.
  • Armstrong & Hatfield vs. Rosenthal Retirement Planning (FINRA # 08-00737): Successfully represented brokers in FINRA arbitration accused of violating non-compete agreement and misappropriating client information from investment advisory firm.
  • In re Fleming Securities Litigation, (No. MDL 1530 [E.D. Texas]): Represented top officers in class action securities litigation, fraud actions filed by Post Confirmation Trust, rescission actions filed by insurance carriers and “zone of insolvency” claim filed by major oil company.
  • Jag Media Holdings, Inc, et al. v. A.G. Edwards & Sons, Inc. et al., (No. H-02-2867 [S.D. Texas, 2004]): Motion to dismiss granted on behalf of large group of financial service clients accused of short selling Jag Media stock.
  • Malone v. Addison Insurance Marketing, Inc., 225 F. Supp.2d 743 (W.D. Kentucky 2002): Motion to dismiss granted on behalf of broker-dealer client accused of securities fraud.
  • Learn2.com, Inc., v. Bell, Lexis 14283 (N.D. Tex. 2000): Defended V.P. of software company accused of misappropriation of trade secrets.
